Quick answer
How do you appeal IRMAA?
You appeal IRMAA by filing Form SSA-44 with Social Security when a life-changing event lowered your income, such as stopping work, marriage, divorce or the death of a spouse. You estimate your current-year MAGI, attach proof of the event and of the lower income, and SSA recalculates the premium using the newer year.
Key takeaways
- 01Eight events qualify, listed in 20 CFR §418.1205.
- 02Work stoppage or reduced hours is the most common qualifying event.
- 03Selling stock is ordinary investment risk, not a qualifying event.
- 04File with evidence: proof of the event and of lower income.
| Form | SSA-44 |
|---|---|
| Rule | 20 CFR §418.1205 |
| Most common event | Work stoppage or reduction |
| Not qualifying | One-time capital gains |
| Evidence | Employer letter, tax return, estimate |
| Wrong data instead? | Request reconsideration |
The Short Answer
How do you appeal IRMAA?
You appeal IRMAA by filing Form SSA-44 with Social Security when a life-changing event lowered your income, such as stopping work, marriage, divorce or the death of a spouse. You estimate your current-year MAGI, attach proof of the event and of the lower income, and SSA recalculates the premium using the newer year.
If you think SSA used the wrong numbers rather than the wrong year, for example an amended return or an IRS error, you request a reconsideration instead. A one-time capital gain from selling stock is not a life-changing event, so it cannot be appealed under SSA-44.
Qualifying Events
What counts as a life-changing event for IRMAA?
Social Security's regulation lists eight events. If one of them reduced your income, you can ask SSA to use a more recent tax year:
| Event (20 CFR §418.1205) | Typical evidence | Notes |
|---|---|---|
| Death of your spouse | Death certificate | Filing status often changes too |
| Marriage | Marriage certificate | Can lower or raise IRMAA |
| Divorce or annulment | Divorce decree | |
| You or your spouse stop working or reduce hours | Employer letter, final pay stub | The most common appeal |
| Loss of income-producing property | Insurance claim, police or disaster report | Not ordinary investment losses |
| Scheduled end or reorganization of an employer pension | Plan notice | |
| Employer settlement due to closure or bankruptcy | Settlement letter |
The property-loss event is narrow: it covers disasters, arson, theft or fraud by a third party, and specifically excludes losses from the ordinary risk of investment. A falling stock price does not count.
How to File
How do you file Form SSA-44?
Read your IRMAA notice
It states the tax year and MAGI SSA used. Check them against your return first.
Identify the event and the date
For retirement, the last day of work or the date hours were reduced.
Estimate MAGI for the new year
Use the year the premium applies to, or the year after the event.
Gather proof
Employer letter or final pay stub for work stoppage; a signed return or estimate for the income.
Submit SSA-44
By mail, in person, or as SSA instructs. Keep copies of everything.
Reconcile later
When the actual return is filed, SSA compares it with your estimate and adjusts.
Example
How much can a successful IRMAA appeal save?
A couple who retired in 2025 with 2024 MAGI of $400,000 would be in the fourth joint tier for 2026, about $9,240 a year above standard premiums. If their 2026 MAGI will be $180,000 and they appeal on work stoppage, SSA can move them to the standard premium.

Where Embark fits
A stock sale can't be appealed with SSA-44. Can the shares pay you without one?
Run your ticker to see what income a position could target with $0 tax at contribution.
- A §721 in-kind contribution is not a sale: $0 tax at contribution, so no capital gain lands in MAGI that year
- Avoids the one-year gain spike that a large stock sale creates two years before your Medicare bill
- Targets 10%+ annual income from shares you already own; that income is taxable and counts in MAGI

What Does Not Qualify
Can you appeal IRMAA caused by a stock sale?
Generally no. A capital gain from selling stock, a Roth conversion or a large IRA withdrawal is not one of the eight events. If your income spiked for one of those reasons, IRMAA applies for that premium year and then falls away the year after if income drops back.
Do
- Appeal when retirement or reduced hours lowered your income
- Request reconsideration if SSA used wrong or amended figures
- Plan big gains so they do not fall in lookback years
Don't
- File SSA-44 for an investment gain or loss
- Underestimate MAGI on the form; it is reconciled later
- Wait: premiums are adjusted only from the request onward in many cases
Embark
How do you keep the next lookback year clean?
Because a stock sale cannot be appealed, the planning has to happen before it. Contributing appreciated shares to Embark under §721 is not a sale, so there is $0 tax at contribution and no gain lands in that year's MAGI. Embark targets 10%+ annual income, which is taxable and counts toward MAGI. Shares have a 3-year lock-up and Embark is for accredited investors. See how to avoid IRMAA.
